Lisa Bitter to be New BYH Managing Member

BYH has selected Lisa Bitter to be the new Managing Member for the firm.  Lisa will take over from Tom Yocum, who has long served in that role.  Lisa will officially begin as Managing Member on March 1, 2018.  In addition to her full-time practice, as Managing Member, Lisa will be responsible for the firm’s day-to-day as well as strategic management. Everyone at BYH would like to thank Tom for his significant investment of time and energy over the years serving as our Managing Member, and we wish Lisa all the best as she assumes this important role.    

Tim Heather one of Cincinnati Magazine’s Top Lawyers

Tim Heather was named in the January, 2018 listing of Cincinnati Magazine’s top lawyers in Southwest Ohio and Northern Kentucky.  He was one of eleven lawyers listed in the “General Personal Injury Defense” category.

BYH Brief Persuasive in Kentucky Supreme Court Decision Regarding Unjust Enrichment and the Payment of Subcontractors

Tom Yocum prepared and filed an amicus curiae brief on behalf of the American Subcontractor’s Association (ASA) in an important decision before the Kentucky Supreme Court regarding subcontractor payment.  The Kentucky Supreme Court cited extensively to this amicus (“friend of the court”) brief in its decision.  The decision is a victory for subcontractors in Kentucky.  It found that construction owners can be “unjustly enriched” when subcontractors go unpaid. 

 Specifically, the Kentucky Supreme Court ruled on Dec. 14 that a construction owner received substantial benefit in a situation when subcontractors had indisputably performed under the contract and the construction owner had never paid for that work. The ruling is a victory for construction subcontractors and the American Subcontractors Association, which urged the state’s high court to reverse an appeals court decision in the case of Superior Steel, Inc. and Ben Hur Construction Company, Inc. vs. the Ascent at Roebling’s Bridge, LLC, Corporex Development & Construction Management, LLC, Dugan & Meyers Construction Company and Westchester Fire Insurance Company.  A link to the complete Kentucky Supreme Court Decision is:

James Salmon is New ASA Ohio Chapter Executive Director

James Salmon, BIM/IPD consultant for BYH, has been selected as the new Executive Director of the Ohio Chapter of the American Subcontractors’ Association (“ASA”).  James’ goals in this new position are to increase ASA membership and expand educational opportunities.   Although his responsibilities are throughout the state, James will maintain his physical office at Collaborative Construction, LLC in Cincinnati.  

Tom Yocum Has a New Grandchild

 On January 4, 2018, Harper Maryland Amann was born, a healthy 7 # 15.6 oz. This is the second grandchild of Tom’s from his daughter Leo and her husband Justin.  Both baby and mother are healthy and mother and father are exhausted. 

Ben Iaciofano

 Principal Tony Iaciofano’s son, Ben Iaciofano (age 23), graduated on December 15, 2017 from Eastern Kentucky University, with a Bachelor’s of Science degree in Animal Studies.  Ben, a four year track and field athlete (hurdles his specialty) for the EKU Colonels, now embarks on his dream of becoming a zookeeper.  He is currently working for Tony’s of Lexington while applying for summer internships at many zoos in the region, including our own Cincinnati Zoo and Botanical Gardens. 

Ellen Iaciofano

 Principal Tony Iaciofano’s oldest child, daughter Ellie (age 26), has just successfully completed the academic/didactic portion of the curriculum at the University of Toledo Physician Assistant program.  Ellie will now begin her ten month rotational period in the field at Mercy Hospital Fairfield’s Emergency Department.  She will graduate in December of this year!
